Overview

While Weiss Law Office generally represents insurance companies, an increasingly large part of our practice is representing policyholders on coverage disputes that they have with their own insurers. We are often able to bring about the resolution of these disputes by reviewing and explaining the available coverage under the policy or policies to the insurer or the policyholder, and sometimes, to both. However, in those instances when the insurers take the wrong position on coverage, Weiss Law Office has the knowledge and skill to successfully litigate the coverage issues with those insurers.

Weiss Law Office is routinely retained by policyholders because of our reputation in understanding the complexities of insurance coverage, and our success in handling these coverage cases. For example, Weiss Law Office was hired on behalf of a policyholder whose carrier withdrew from defending that company in the middle of a lawsuit. The coverage battle took place in federal court. Eventually, the United States Court of Appeals for the 7th Circuit agreed with the position that Weiss Law Office advocated. Based on the arguments presented, the court declared that the policy provision relied upon by the insurer created illusory coverage and struck that provision. Crum & Forster Specialty Insurance Company v. DVO, Inc., 939 F.3d 852 (7th Cir. 2019).  This case is just one of many successes that Weiss Law Office has been able to achieve on behalf of its policyholder clients.

A significant portion of the policyholder work that this firm receives comes from other attorneys who steer their clients to Weiss Law Office for representation. These referrals are perhaps the greatest compliment that we could receive. Other attorneys are entrusting us to represent their clients on matters that they cannot handle. We continued to be honored by such confidence placed in the work that we perform.
